There are three ways to apply for Social Security benefits:
- You can go into your local Social Security office and apply in person.
- You can apply online at the Social Security Administration’s website.
- You can call the Social Security Administration at 1-800-772-1213 and apply over the phone.
The examiner in charge of your case is tasked with asking five questions:
- Are you currently working?
- Is your condition severe enough to prevent you from working?
- Is your condition listed on the SSA’s list of approved impairments?
- Will you be able to do the work you were doing in the next 12 months?
- Can you transition to any other type of work?
The short answer is yes. Individuals who have been turned down are the majority of cases a Social Security lawyer works with. Many claims are denied because they are simply lacking the required documentation to get approval. We can help ensure your claim is backed up with solid evidence showing you should be eligible for disability.
Absolutely. While a lot of disability insurance policies limit mental health benefits to 24 months, Social Security Disability doesn’t differentiate between mental and physical impairments. In fact, many approved claims include both mental and physical conditions.
Yes. The Social Security Administration requires your disability to be extreme enough that it will limit your ability to work for 12 months.
The Social Security Administration wants you to be able to return to the work force in a healthy way. That said, they have strict regulations for how much income you’re able to receive while getting benefits. If you start to earn above that amount, your benefits will likely be revoked.
Every case varies, but oftentimes dependents under 18 will be eligible to receive benefits. Typically your dependents will split an amount equal to 50% of your disability check.
The good news is that if you become eligible for other Social Security benefits (retirement, for example) your monthly financial assistance will not change. The allocated amount will just transfer and begin coming from whichever program you’re now eligible for.
